Terms of Use

These Terms of Use ("Terms") govern your use of the Momentum iOS and watchOS application ("Momentum", "the app"). Momentum is provided by Brad de Groot, trading as SquishyHQ, an Australian sole trader ("we", "us", or "our").
By downloading, installing, or using Momentum, you agree to these Terms. If you do not agree, please do not use the app.
1. The app
Momentum is a running interval training app. It provides structured training plans including Start Running, Couch to 5K, and 5K to 10K — designed to help you progress through a running program at your own pace.
The app includes a watchOS companion that runs on Apple Watch.
2. Licence
We grant you a personal, non transferable, non exclusive licence to use Momentum on any Apple branded device that you own or control, in accordance with these Terms and with the Apple Media Services Terms and Conditions (the Usage Rules), which form part of the licence to use the app. Family Sharing and Legacy Contact access are permitted where Apple's terms allow.
You may not:
Copy, modify, reverse engineer, decompile, or attempt to derive the source code of the app, except to the extent permitted by law.
Distribute, sublicense, rent, lease, or resell the app.
Remove or alter any proprietary notices.
Use the app for any unlawful purpose.
3. Subscriptions and payment
Momentum offers auto renewing subscriptions to unlock the full set of training plans and features. Subscriptions are sold and billed by Apple through the App Store.
Subscription options
Single Plan — billed every 3 months
Multi Plan — billed annually
Current pricing is displayed within the app at the point of purchase. Prices may vary by region and are presented in your local currency by Apple.
How auto renewal works
Payment is charged to your Apple Account upon confirmation of purchase.
Your subscription automatically renews at the end of each billing period unless auto renewal is turned off at least 24 hours before the end of the current period.
Your Apple Account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
You can manage your subscription and turn off auto renewal at any time in Settings → [Your Name] → Subscriptions on your device.
Free content
Some training content in Momentum is available without a subscription. The specific content available without a subscription may change over time at our discretion.
Refunds
Refunds for App Store purchases, including subscriptions, are handled by Apple. To request a refund, visit reportaproblem.apple.com and follow Apple's process. We do not directly process refunds for App Store transactions.
Price changes
If we change the price of a subscription, the new price will not take effect for your existing subscription until the start of your next billing period, and where required by law you will be asked to consent to the new price before it applies.
4. Health and fitness disclaimer
Momentum provides general training plans and is intended for use by healthy adults. The app is not a medical device and does not provide medical advice, diagnosis, or treatment.
Before beginning any new exercise program, including the use of Momentum, you should consult a qualified healthcare professional, particularly if you:
Have a pre existing medical condition
Are pregnant or have recently given birth
Are recovering from injury or surgery
Experience chest pain, dizziness, or other warning symptoms during exercise.
You use Momentum at your own risk. Listen to your body, stop exercising if you feel unwell, and seek medical attention if needed.
5. HealthKit and location data
If you grant Momentum permission to access HealthKit, the app may read and write workout and related health data on your device. If you grant location permission, the app records the GPS route of your runs and stores it as part of the workout in the Health app. This data remains on your device and under your control. You can revoke HealthKit permissions at any time in Settings → Health → Data Access & Devices → Momentum, and revoke location permissions in Settings → Privacy & Security → Location Services → Momentum.

6. Intellectual property
Momentum, including its training plans, designs, code, audio cues, graphics, and branding, is owned by Brad de Groot and is protected by copyright and other intellectual property laws. These Terms do not transfer any ownership rights to you. The licence granted in Section 2 is your only right to use the app.
7. Updates
We may release updates to Momentum from time to time. Updates may add, change, or remove features. Updates are delivered through the App Store and may be installed automatically depending on your device settings.
8. Termination
You may stop using Momentum at any time by deleting it from your device. Your subscription will continue to auto renew until you cancel it through your Apple Account, regardless of whether the app is installed.
We may suspend or terminate your access to the app if you breach these Terms or use the app in a way that is unlawful or that we reasonably believe causes harm. If your access is terminated due to breach, you are not entitled to a refund of any subscription fees.
Apple may also remove the app from the App Store or terminate your access in accordance with Apple's terms.
9. Warranties and consumer guarantees
To the maximum extent permitted by law, Momentum is provided "as is" and "as available" without warranties of any kind, whether express or implied.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be lawfully excluded. If a consumer guarantee under the Australian Consumer Law applies, our liability is limited (at our option) to re supplying the app or paying the cost of having the app re supplied, to the extent permitted by law.
For users outside Australia, equivalent non excludable consumer protections in your jurisdiction continue to apply.
10. Limitation of liability
To the maximum extent permitted by law, and subject to Section 9, we are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of Momentum, including (without limitation) injury, loss of data, or loss of profits.
Our total aggregate liability to you for any claim arising out of or in connection with the app or these Terms is limited to the amount you have paid us (via Apple) for the app in the 12 months preceding the event giving rise to the claim.
11. Apple as third party beneficiary
You acknowledge that these Terms are concluded between you and us, not with Apple, and that we (not Apple) are solely responsible for the app and its content. Apple and Apple's subsidiaries are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary.
Apple has no obligation to provide any maintenance or support for the app, and no warranty obligations with respect to the app. Any claims relating to the app including product liability, failure to conform to applicable legal requirements, and claims under consumer protection or privacy law are our responsibility, not Apple's, in accordance with these Terms.
In the event of any third party claim that the app or your possession and use of it infringes that third party's intellectual property rights, we (not Apple) are solely responsible for investigation, defence, settlement, and discharge of such claim.
12. Export and legal compliance
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with applicable third party terms when using the app (for example, your wireless data plan terms).
13. Governing law
These Terms are governed by the laws of Victoria, Australia. Subject to any non excludable rights under the Australian Consumer Law or equivalent laws in your jurisdiction, you and we submit to the non exclusive jurisdiction of the courts of Victoria for any disputes arising under these Terms.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you within the app. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
